Egwyddorion y GDPR:
Beth yw’r GDPR?
Mae’n sefyll am ‘General Data Protection Regulation’ (Y Rheoliadau Diogelu Data Cyffredinol yn Gymraeg neu RhDDC) ac yn ymwneud â data personol (yn unig). Mae’n rheoleiddiad (rheol) o’r Undeb Ewropeaidd sy’n rheoleiddio’r defnydd o wybodaeth bersonol. Daeth i rym ar 25.05.18. Mae’n debyg iawn i’r Ddeddf Diogelu Data (DDD, 1998) mewn nifer o ffyrdd ond yn ei ddisodli. Felly mae’r egwyddorion yn debyg i raddau helaeth i’r rhai a nodir yn y ddeddfwriaeth gyfredol ond fe’u cryfheir gyda phwyslais ar y sail gyfreithiol am brosesu data, mwy o ddyletswydd i gofnodi ac mae’n rhoi hawliau ychwanegol a mwy o dryloywder/gwybodaeth i unigolion.
Beth yw egwyddorion GDPR (RhDDC)?
Rhaid i ddata personol:
Cael ei brosesu’n deg, yn gyfreithlon ac yn dryloyw.
Cael ei gasglu at ddibenion penodol, eglur a dilys.
Bod yn ddigonol, perthnasol ac angenrheidiol
Bod yn gywir a lle bo angen, yn gyfoes
Cael ei gadw mewn ffurf adnabyddadwy am ddim mwy o amser nag sydd angen
Cael ei brosesu’n ddiogel
Beth yw hawliau’r unigolyn o dan y GDPR? Mae angen dweud wrth ddeilydd data am eu hawliau pan fyddwch yn casglu gwybodaeth bersonol. Felly’r hawl:
I gael gwybod (am eu hawliau ac am y ffaith bod eu data yn cael ei brosesu)
I gael mynediad/’Subject Access’ (30 diwrnod i gydymffurfio, ni allwch godi ffi a rhaid cadw cofrestr o geisiadau)
I gywiro
I ddileu
I gyfyngu prosesu
I symudadwyedd (‘portability’) data (e.e. i symud eu data o un sefydliad i un arall)
I wrthwynebu
Mewn perthynas â gwneud penderfyniadau awtomataidd
Beth yw’r sail gyfreithiol o ran prosesu data?
